By creating an account or using the Every Run app or website (the "Service"), you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service. You must be at least 13 years old (or the age of digital consent in your country).
Every Run helps you track ski runs, view resort trail maps, and record your season. Trail maps, run difficulty, lift status, conditions, crowd data, and similar information are provided for general reference and entertainment only.
You understand and acknowledge that skiing, snowboarding, and other mountain and snow sports are inherently dangerous activities that can result in serious injury, permanent disability, or death. You voluntarily participate in these activities at your own risk. You are solely responsible for your own safety, for skiing in control and within your ability, for obeying all resort signage, rules, and closures, and for following the Your Responsibility Code. Every Run does not make the mountain safe and is not a substitute for your own judgment, a guide, ski patrol, or resort staff.
Maps, positions, routes, and any location data in the Service may be inaccurate, incomplete, or out of date and must not be relied upon for navigation, route-finding, avalanche assessment, or in any emergency. In an emergency, contact ski patrol or local emergency services directly. Do not use the app while skiing in a manner that distracts you.
The Service is provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that any data (including maps, difficulty ratings, conditions, or GPS tracks) is accurate or complete.
To the maximum extent permitted by law, Every Run LLC and its owners, employees, and suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any personal injury, death, or property loss arising out of or related to your use of the Service or your participation in any activity. Our total liability for any claim will not exceed the greater of (a) the amount you paid us in the twelve months before the claim, or (b) US $50.
You agree to defend, indemnify, and hold harmless Every Run LLC and its owners and staff from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising from your use of the Service, your participation in mountain activities, or your violation of these Terms or the rights of any third party.
Paid features (Pro, day passes, family plans, founder tier, merchandise, and posters) are billed through the applicable app store or our payment processor. Store purchases are governed by that store's terms; subscriptions renew until cancelled in your store account. See the EULA for app-license terms.
Keep your credentials secure. Don't misuse the Service, upload unlawful content, or infringe others' rights. We may suspend or terminate accounts that violate these Terms.
We may update these Terms. If we make material changes, we'll ask you to re-accept in the app. Continued use after changes means you accept the updated Terms.
These Terms are governed by the laws of the State of Utah, USA, without regard to conflict-of-law rules. (Confirm venue/arbitration language with your attorney.)
